Description

Tax returns are the first document from which Inland Revenue Department (“IRD”) obtains information about a taxpayer and from which issues requiring further queries or even tax audits are identified. In almost every year including 2021/22, the IRD adds new questions to the tax return, and the additions may give hints on the IRD’s new focus of review. Whether a question in a tax return is new or old, taxpayers should be careful in responding to each item, bearing in mind whether any additional information should be submitted together with the tax return to avoid misunderstanding, what further queries this may lead to, what supporting documents you should get prepared for, and how your tax affairs should be planned for future years. Taxpayers should also stay alert to new developments in Hong Kong taxation, e.g. taxation on foreign source passive income.

Speaker Profile

Philip is a Director in PricewaterhouseCoopers Ltd. He has over 35 years’ experience in Hong Kong taxation with six years in IRD. He is a well-known expert in the tax field and investigation specialty. After he left the IRD, Philip concentrated in assisting clients in handling tax investigation and field audit cases. Philip is the first to set up a specialized team to handle the IRD’s tax investigation and field audit cases for clients in the industry. His clients include SME, listed companies and various MNC, involving complicated cases such as worldwide onshore/offshore claim, disputes on contracting processing and import processing arrangements, transfer pricing adjustments, etc.

Philip is a regular speaker on tax audit and frequently contributes newspaper and magazines articles on the related topics.

Felix has over 15 years of experience in resolving tax audits, tax investigation and other tax disputes for multinational corporations and local SMEs in different industries including manufacturing, services, fund management and charitable institutions, involving a diverse range of issues such as offshore claims, cross-border transactions, contract / import processing arrangements, anti-avoidance, carried interest, transfer pricing, tax exemption claims and Board of Review proceedings. With insights in tax dispute resolution, Felix also has comprehensive experience in providing practical tax and business advice from a dispute prevention angle, including tax health check, defence file building, post-audit restructuring, tax due diligence, fee structure for fund management, and charity set up.

Nicki is a manager at PwC Hong Kong. She has over 5 years of experience in providing tax compliance and business consulting services for local, regional, multi-national and listed companies, including offshore claims, applications for tax treaty benefit and tax planning work for cross-border transactions. Nicki has also assisted companies and individuals in handling tax audit and investigation cases and prolonged tax disputes, and conducting health checks and tax planning. The client industries mainly include trading, retail and consumer product, NGO, shipping and logistic etc.
