Description

Hong Kong has established its transfer pricing legislation to meet international standards in 2018. This means that the arm’s length standard has become the guiding principle and operating basis for all multinational enterprises operating in Hong Kong. The Hong Kong transfer pricing landscape is shifting as taxpayers face uncertainties from the on-going COVID-19 pandemic and the Organization for Economic Co-operation and Development (OECD)’s Base Erosion and Profit Shifting (BEPS) project. This webinar attempts to assist transfer pricing practitioners to rethink the intercompany transactions under the current transfer pricing environment. In particular, we will discuss the following practical issues:

  • Arm’s length principle and functional profile in different intercompany settings;
  • Treatment of Hidden Transactions especially from Audit Financial Statement;
  • Documentation and Comparability Analysis during COVID-19 pandemic; and
  • Other practical aspects of transfer pricing compliance and planning.

Speaker Profile

Dr Hsu has extensive global transfer pricing experience as he had been a transfer pricing economist at big four accounting firms in China, Hong Kong, and US offices since 1999. The clients Enoch serves are in various industries, such as consumer products (apparel, electronics, and retail), financial services, technology and telecommunication, software. He is highly proficient in assisting multinational enterprises in preparing global transfer pricing exercises for both compliance and advisory purposes.

As an experienced transfer pricing economist, Dr Hsu has assisted multinational corporations in restructuring their business organisations by performing robust financial and economic analyses for business operations. In doing so, he helps the companies to design and construct effective business structures and supply chain models to achieve operational efficiency. Enoch has also conducted a wide range of intangible valuation projects from tax and transfer pricing perspective. Through negotiating with tax authorities, he has aided clients to obtain advantageous outcomes in cost-sharing arrangements and advance pricing agreements. Moreover, while working in China, Enoch has built his rapport with tax authorities to resolve tax controversies and disputes.

Prior to his transfer pricing profession, Dr Hsu was an adjunct professor of Economics at Santa Clara University for three years. He taught principles of microeconomics, corporate finance, and intermediate microeconomics. He also taught international economics at the MBA level of Leavey School of Business. Enoch has obtained his doctoral degrees in Economics from Claremont Graduate University in 1998.

Michelle started her career in PRC tax and business advisory including transfer pricing services for about 10 years. For the past 3 years she has chosen to specialize in transfer pricing services and she is familiar with Hong Kong and PRC transfer pricing fields. Michelle’s transfer pricing experiences include provision of health check, restructuring of business model and planning exercises, IPO review, preparation of transfer pricing documentation and country-by-country report for private and listed MNCs.

Michelle’s client portfolio in transfer pricing includes private companies, multinational groups and listed groups engage in trading, manufacturing, logistics, business service, etc.

Michelle is a member of the Hong Kong Institute of Certified Public Accountants. She holds a Master of Arts (Honours) in Business Studies and Accounting with University of Edinburgh.
