With the introduction of BEPS2.0 by the OECD and the recent changes in the leadership within the Inland Revenue Department (IRD), there have been developments in the way the IRD selects files for review and audit, and their approach in conducting tax audits.

In this session, PwC Tax Controversy Services specialists will provide updates and share insights on the recent development in the IRD’s practices towards case selection, approach in conducting tax audits, and settlement negotiation. Specifically, the seminar/webinar will cover the followings:

  • Overview of the IRD’s case selection process and process of tax audit in Hong Kong
  • Update on the latest changes in the leadership within the IRD and their implications
  • Latest trends of IRD’s review focus and approaches in conducting tax audits
  • Tips for settlement negotiation in the current environment

Speaker Profile

Philip has over 30 years’ experience in Hong Kong taxation with six years in IRD.He is a well-known expert in the tax field and investigation specialty. After he left the IRD, Philip concentrated in assisting clients in handling tax investigation and field audit cases. He is the first to set up a specialized team to handle the IRD’s tax investigation and field audit cases for clients in the industry.

Philip’s clients include charitable institutions, fund managers, SME, listed companies and various MNC. He assisted in handling complicated cases such as the IRD’s review on major charitable institutions, worldwide onshore/offshore claim, disputes on contracting processing and import processing arrangements, offshore claim for Macao Offshore Company, IRD prosecution case and transfer pricing adjustments.

Flora has over 10 years’ experience providing Hong Kong tax controversy services to multinational corporations, local entities as well as charitable institutions, and providing Australian tax advisory and compliance services to conglomerates, listed companies and large private groups in Australia before joining the team in Hong Kong.

In particular, Flora assisted clients in resolving tax disputes with the Hong Kong tax authorities, handling tax audits conducted by the Hong Kong Inland Revenue Department and has experience in managing Board of Review proceedings for overseas clients. The controversial Hong Kong tax issues that Flora has managed include offshore claims on trading profits, commission income as well as fund management fees, royalty income on intellectual properties exploited outside of Hong Kong, Macao offshore companies, deductibility of intercompany charges and stamp duty. Flora also assisted clients to prevent and manage tax controversial issues such as capital gains, and tax residency status, and advise on group restructuring.
