Businesses globally are being severely impacted by Coronavirus. Hong Kong has been affected recently by the Coronavirus “COVID-19 ” as well. During these periods, both Employers and Employees are very concerned about their employment legal rights (including “Work From Home arrangement”, “No Pay Leave”..etc.

Professor Albert So Man Kit (Practicing Solicitor and Chairman of Hong Kong Mediation and Arbitration Centre) will share and discuss the following common legal issues in this seminar.

Legal liability and statutory protection of both Employers and Employees during the periods of Coronavirus (COVID-19). For examples:

 

1. The outbreak of the Coronavirus has been posing significant challenges to many businesses. That being the case, can Employers lay off Employees immediately owing to the closedown of business, or can they demand Employees to take mandatory “No pay leave” until Employers ”further notice”?

2. Can Employees refuse to work if their Employers did not provide sufficient facial masks or protective devices at the workplace?

3. For those Employees who have “Work from Home” arrangement, will their injuries at home be regarded as “Work-related Injuries”, such that they can be covered under the Employee Compensation Ordinance?

4.  Can the Employers require their Employees to do (or not to do) particular acts during the periods of Coronavirus (such as wearing facial masks at workplace. etc.
